Welcome to Circles, provided by Evantiv Digital Labs Pte. Ltd. ("Evantiv", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your access to and use of the Circles website and mobile applications ("Service").
Acceptance of Terms
By accessing or using our Service, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using our Service.
Description of Service
Circles provides a flexible, subscription-based platform delivered through our website and mobile applications, designed to manage HR processes for small and medium enterprises across the globe.
Account Registration and Management
Users must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your account details and all activities that occur under your account.
Subscription Terms
We offer a 15-day free trial to new users. After the trial, subscriptions automatically renew, and users are billed according to the plan selected unless the subscription is canceled.
Subscription Models and Pricing
Circles offers a flexible range of subscription models designed to meet the diverse needs of small and medium enterprises. Below are the key details related to subscription options, pricing, and features:
Free Trial
15-Day Trial: New users are eligible for a 15-day free trial, during which they can access all available features of Circles at no cost. After the trial period ends, users will be required to select and subscribe to one of the paid plans.
Payment Terms
- All subscriptions are billed on a monthly or annual basis, depending on the plan selected by the user. Payment must be made using the available payment methods, including major credit cards and PayPal.
- The subscription fee is due in advance and will be charged at the beginning of each billing cycle.
- Users can view and manage their subscription, including upgrading or downgrading plans, within their account settings.
Renewal and Cancellation
- Subscriptions automatically renew at the end of the billing cycle unless canceled by the user prior to the renewal date.
- Users may cancel their subscription at any time through the account settings page. Cancellations will take effect at the end of the current billing cycle, and no refunds will be provided for partial months of service.
Additional Features
Circles continues to introduce new modules and functionalities. Some features may be available as add-ons that can be purchased separately from the subscription tiers.
User Conduct and Responsibilities
Users are expected to use the Service lawfully and are prohibited from violating privacy, spreading malware, and engaging in fraudulent activities.
Intellectual Property Rights
All intellectual property rights related to the Service and its content are owned by Evantiv or its licensors.
Privacy Policy
We commit to protecting personal and payment information in accordance with our Privacy Policy, which adheres to GDPR, CCPA, and other applicable data protection laws.
Disclaimers and Limitation of Liability
The Service is provided on an "as is" basis. Evantiv will not be liable for any interruptions or the lack of availability of the services.
Indemnification
Users agree to indemnify Evantiv against any claims, damages, or expenses arising from their use of the Service or violation of these Terms.
Changes to the Service and Terms
Evantiv and Circles reserve the right to modify the Service or Terms at any time. Users will not be notified of these changes unless they are significant.
Termination of Use
Users may cancel their subscriptions at any time via their account settings. Evantiv and/or Circles also reserves the right to terminate access for breach of these terms.
Dispute Resolution
Disputes will be resolved through an escalating process from direct communication to binding arbitration in Singapore under the rules of the International Commercial Arbitration Court.
Governing Law and Jurisdiction
These Terms are governed by the laws of Singapore. All disputes will be resolved exclusively under the jurisdiction of Singapore courts.
Miscellaneous
This agreement constitutes the entire agreement between you and Evantiv. Provisions that are deemed unenforceable do not affect the enforceability of other provisions.
